Terms of Service
1. Agreement to Terms
These Terms of Service (“Terms”) are the agreement between you (“you” or “your”) and Mnemo Africa(“Mnemo”, “we”, “us” or “our”) about your use of this website and the Mnemo service, including Mnemo Books, Mnemo Stories and Mnemo Prints (together, the “Service”).
By creating an account or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Service. Please read these Terms, and our Privacy Policy, once.
2. Eligibility
You must be 18 or older, or use Mnemo with a parent or guardian’s involvement. If you use the Service on behalf of an organisation, you confirm that you have the authority to agree to these Terms for it.
3. Account registration
- Give us accurate details and confirm your email address.
- Keep your password private. You are responsible for what happens under your account.
- Tell us straight away if you think someone else has used your account.
- You can delete your account at any time from Account settings.
4. Description of Service
Mnemo turns your photographs into printed books. You upload photos, design your book, review it, approve it and order it, and we print and deliver it within Kenya. We also offer related services such as Mnemo Stories, a professional storytelling service for brands and organisations.
5. Acceptable use
You agree to use the Service fairly. Do not:
- try to break into the Service, other people’s accounts or our systems;
- overload or disrupt the Service;
- copy the Service or use automated means to collect from it;
- use the Service to harm others or to break the law.
We may suspend or close accounts that break these Terms, and will tell you why where we can.
6. Intellectual property and your content
6.1 Our property
The Service, including its design, features and code, belongs to Mnemo. These Terms give you only the right to use it as described here.
6.2 Your content
The photos, text and designs you upload or create remain yours. To make your book, you give us permission to store, copy, resize, process, print and deliver your content, and to show it to the people you invite. That permission ends when you delete the content or your account, apart from the records we must keep for ordered books, as described in the Privacy Policy.
You promise that you have the right to use everything you upload, and that it does not:
- break the law or anyone’s rights, including copyright and privacy;
- show or sexualise children, or contain sexually explicit, hateful or threatening material;
- include other people’s private photos that you have no right to share.
We and our print partner may refuse to print content that breaks these rules, and may remove it. If we refuse an order, we will refund you in full.
7. Shared books
The person who creates a book is its owner. The owner decides who is invited and can remove collaborators. Collaborators can add photos and edit pages in that book, and what they add stays in it after they are removed. Only the owner can approve and order the book.
8. Approving your book
Before you can order, you review a preview and a print check. You then approve the final version. What you approve is exactly what we print, including photos, text, order of pages, paper and cover. Please check it carefully.
The print check warns you about things like low-resolution photos. If you choose to go ahead, we print it as approved and cannot make the photo sharper. After you order, the book can no longer be changed.
9. Prices and payment
- Prices are in Kenyan shillings (KES). The total, including delivery (or free collection) and any discount, is shown before you pay.
- We calculate the price on our servers from your actual book. If a price is shown wrongly by mistake, we will tell you before we make your book.
- You can currently pay with M-Pesa or by card (Visa and Mastercard). Payments are processed by Paystack, our payment partner, and its terms and privacy policy apply to the payment itself. Your order is confirmed when we receive your payment.
- Discounts and Mnemory Points can’t be combined where we say so at checkout.
10. Cancelling and refunds
10.1 Cancelling an order
You can cancel an order within 2 hours of placing it, and you will get a full refund. We process refunds within 2 business days of cancellation. After 2 hours your book goes into production and the order can no longer be cancelled.
10.2 Damaged or faulty books
If your book arrives damaged, or has a printing fault caused by us, contact us promptly at [email protected] with your order number and photos, and we will put it right by reprinting it or refunding you. A book that looks different from what you approved, such as because of a low-resolution photo you chose to keep, is not a fault.
11. Delivery and collection
You can have your book delivered within Kenya, or, where we offer it, collect it yourself from a Mnemo collection point at no delivery charge. The delivery price depends on your town and is shown before you pay. Delivery times shown are estimates, not promises, and depend on production and the courier. You can follow your order from your account. Please give a correct address and phone number, as the courier may need to call you.
If you collect, we email you a collection code when your book is ready. Bring the code and your order number. We keep a finished book for the number of days shown at checkout. A printed book is made to your design and can’t be cancelled once the cancellation window has passed, so please collect it within that time.
12. Your digital copy
After you pay you can download a PDF copy of your approved book. It is for your personal use, to view on screen. It is not a print-ready file.
13. Mnemory Points
- Points have no cash value and can’t be transferred or sold.
- You can use them as a discount in the steps shown at checkout.
- If you cancel an order, points earned from it are taken back and points you spent on it are returned.
- We may change how points are earned and spent, or end the programme. We will not take away points you have already earned without good reason, such as misuse.
14. Mnemo Stories
Mnemo Stories projects are agreed individually. Scope, price, timing and ownership of the finished work are set out in a quote or agreement for each project, which applies together with these Terms.
15. Service availability
We take care in making your book, but we can’t promise the Service will always be available or free of errors. It may be unavailable for maintenance or because of problems outside our control.
16. Account termination
16.1 By you
You can delete your account at any time from Account settings, or by contacting us at [email protected]. What we remove, and what we must keep, is described in the Privacy Policy.
16.2 By us
We may suspend or close an account that breaks these Terms, and will tell you why where we can.
17. Our responsibility
Nothing in these Terms limits any right you have under Kenyan law that cannot be limited. Beyond that, our responsibility for any single order is limited to the amount you paid for it, and we are not responsible for losses we could not reasonably have foreseen.
18. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store and protect your personal information.
19. Changes to Terms
We may update these Terms. The version and “Last updated” date at the top show the latest one. If a change is significant, we will tell you by email before it applies to your next order.
20. Governing law and disputes
These Terms are governed by the laws of Kenya. If we can’t sort a problem out together, the courts of Kenya can decide it.
21. General provisions
- Entire agreement: these Terms, together with the Privacy Policy, are the whole agreement between you and Mnemo about the Service.
- Severability: if a part of these Terms can’t be enforced, the rest still applies.
